MINUTES OF REGULAR MEETING
Town Board
Town of Janesville, Wisconsin
October 6th, 2014

Posted:  Thursday, October 2nd, 2014 at the town office, Lion's Quick
Mart, Consolidated School, Hackbarth Hills Golf Clubhouse,
www.townofjanesville.org.    

Members Present: Chairman Bruce Schneider, Supervisor David Rebout,
Robert Mielke, Gary Fox and Janet Kassel  

Others Present: Clerk Linda Fewell, Treasurer Peggy Augustine, Town
Attorney Richard Hemming, Constable Archie Henkelmann, and (18)
members of the public.
Meeting called to order, by Chairman Schneider at 7:30 p.m., followed
by the Pledge of Allegiance, in the town hall, 1628 N. Little Court,
Janesville, Wisconsin

Senator Tim Cullen, here to present a map of the Town of Janesville
when it was established in 1835.He brought a State of Wisconsin seal
plaque to post in the Town Hall for the residents to view. Stop in and
see our Map from then.

Sheriff’s Department deputy here for questions, Peggy brought up the
totes that are on Polzin Rd. He said he would look into them. 
  
1.	 Minutes of Previous Meeting
 Moved by Rebout, seconded by Fox, that the minutes of the regular
Town
Meeting held September 2nd, 2014 be approved as presented. Motion
carried on voice vote.
	
2.	 Financial Report
      Moved by Mielke, seconded by Fox, that the financial report,
ending 
September 30, 2014, be accepted as presented by Treasurer Augustine.  
       Motion carried on voice vote. Note that we are going to be
going through a 
Revaluation in 2015.
3.	Citizen Participation – 
Doug Rebout- Asked if the ballots can be put on the website? No, we
don’t have a scanner in the office at this time. The Clerk posts
sample ballots at each posting place.
David Rebout- Wondering if John Gerbitz has called to rent the Town
Hall like he did last year? No, have not heard from him as of today.

4.	Recommendation from Planning & Zoning Committee- 
	A. Discussion and possible action on the land transfer- between Mary
Jane Putsch- 
          Marie Canary, 5421 N. Sunny Shore Lane and Donald Handrow,
5431 N. Sunny Shore
          Lane. Transfer Between adjacent lots, 0.1 acre. Present
zoning (SFRR). NW ¼ SW ¼
          Sec. 5. Parcel # 6-8-419.8B
	
     Moved by Rebout, seconded by Fox, to approve the request of
transfer of land
     Between Mary Jane Putsch- Marie Carney and Donald Handrow. Motion
carried on 
     Voice vote. 
      
      B. Discussion and possible action for Bruce Schneider 3001 W.
Hwy 14, for a Preliminary 
         Survey Map, 12 lot subdivision, zoned SFRR section 15. Parcel
# 6-8-134.2
     Moved by Robert, seconded by Kassel, to approve David Rebout as
acting Chairman.
     Schneider stepped down, Motion carried on voice vote.
     The road was in question being a private road and for emergency
vehicles. The  
     Recommendation from the Planning and Zoning was that Bruce make a
statement for 
     Ingress and regress on the road way seeing that it is a private
road. No changes can be
     Forced at this time. Fire truck may have trouble. Town has no say
over a private Rd.
     Bruce will plow and keep the trees trimmed. Garbage truck does
ok.
     Moved by Fox, seconded by Mielke, to approve the recommendation
for Bruce
     Schneider. Motion carried on voice vote.  

Public Hearing
A.  Request, from David & Patrick Anderson 11527 N. Shore Dr. Milton,
WI 53563
    For a zoning change from (A-1) to (SFRR) Lot 1 2.7 M/L acres.
Future zoning of
    Parent Lot to remain (A-1) 42 acres M/L. Town of Janesville
section 15 SE ¼ SE ¼ 
    Parcel # 6-8-141.
    Moved by Kassel, seconded by Rebout, to approve the request for
David & Patrick
    Anderson for a zoning change. Points of interest are the 35 ft.
right of way for future 
    Road. Public road is 70ft wide. Motion carried on voice vote.
 
B.  Request from David & Patrick Anderson, 11527 N. Shore Dr. Milton,
WI 53563 for a 
	    Preliminary Minor Land Division, section 15. Parcel # 6-8-141.
            Moved by Kassel, seconded by Mielke, to approve the
request for David and 
	    Patrick Anderson for the Preliminary Minor Land Division. Motion
carried on voice
           Vote.

C.  Request, from James & Laura Carney, 3804 N. Spring Hill Dr.
Janesville, WI 
          53545 for a zoning change from Exclusive Agricultural
District (A-1) to (A-3)
          16.7 acres, parent Lot 1, 9.4 M/L acres, lot 2, 7.3 M/L
acres. Town of 
          Janesville. Parcel # 6-8-123.01.
	   Moved by Fox, seconded by Mielke, to approve the rezone for James
& 
	   Laura Carney from A-1 to A-3 on 16.7 acres, A-1 to A-3 on 7.3
acres. 
          Motion carried on voice vote.

D. Request, from James & Laura Carney, 3804 N. Spring Hill Dr.
Janesville, WI
        53545 for Preliminary Minor Land Division, section 14, Town of
Janesville. 
        Parcel # 6-8-123.01.
	 Moved by Rebout, seconded by Mielke, to approve the request for
Preliminary
        Minor land division for James and Laura Carney. Motion carried
on voice vote.


5.	 Unfinished Business
A. Implementation of J. Mauel & Associate Pet Licensing, this issue
has been 
  Put on hold for now. Will find out more at the meeting with the
 County November 6, 2014.
B. Discussion on the inspection of the Bridges in the Town. Bruce will
call the 
  County to find out where all the bridges are located, 1 on
Willowdale, 
  2 on Mineral Point Rd, so we will do the inspection upon hearing
from the
  County. Moved by Rebout, seconded by Fox, to approve the inspection
  In 2015. Motion carried on voice vote.
6.    	New Business
      A.	Building Inspector Report- everything going good. 
B.	Moved by Fox, seconded by Mielke, to approve the operator license
for Brandi Wepking, & David Halbach to expire June 30th, 2015. Motion
carried on voice vote.
C.	Moved by Janet, seconded by Fox, to approve giving the Town
Attorney an increase on pay, from $130.00 to $135.00.Motion carried on
voice vote.
	D.	Discussion on the Implementation of the Implements of Husbandry,
there 
	      Are a few different options that we can choose to apply in our
Town? We 
	      Will be discussion this in the next few meetings? Law goes into
effect in 
            2015. We will need to see what the neighboring Towns are
doing. Doug 
	      Rebout will get a hold of the Town of harmony and DACAP to put

	      Together an informational meeting. Agenda for next month.
E.	Moved by Mielke, seconded by Fox, to take Archie’s recommendation
to drop the complaint on the resident at 4611 N. Katherine Dr. Peter
Graves was here to speak on behalf of the low key business he has at
4611 N. Katherine Dr. He washes motor parts in a parts washer uses a
water based chemical and is not dumping on the ground, he disposes of
it properly. He feels this complaint is based on a former friend and
the fact that Peter has a photo of a car of the friend (Bruce Stone)
on his website. There are no complaints from the direct neighbors some
of them are here in support of Peter. Supervisor Janet Kassel feels we
try to live and let live and states to take “no action at this time”
Motion carried on voice vote.
F.	Clerk has a meeting in Oconomowoc on October 8, 2014 office will be
closed.
7.	Reports by Town Attorney.
	1. 	Update on Farmland Preservation- clerk will need to do a class 2
notice 		this will be a November 3rd, 2014 Public hearing.	 
8.    Correspondence       
	Sheriff Report on file at office.
	Chairman Schneider brought up that Town of Center wanted us to go in
half 
	On a street light on the corner of Hwy H and Hwy 14. No we have no
money.
	Supervisor Mielke asked Chairman Schneider to be sure the County is
not doing 
	Work on the roads without our approval.
9.	Vouchers
	Moved by Rebout seconded by Fox, that vouchers # 289 through and
including 	# 311 be approved for payment. Motion carried on voice
vote
10.	 Adjournment
	Moved by Rebout, seconded by Mielke, to adjourn. Motion carried on
      voice vote.
