MINUTES OF REGULAR MEETING
Town Board
Town of Janesville, Wisconsin
March 7, 2016

Members Present:  Chairman Bruce Schneider, Supervisor David Rebout,
Robert Mielke, Gary Fox and Janet Kassel  
Members Absent:  None

Others Present:  Town Clerk Linda Fewell, Treasurer Peggy Augustine,
Constable Archie Henkelmann, Town Attorney Jamie Olson and (23)
members of the public.

Meeting called to order by Chairman Schneider, followed by the Pledge
of Allegiance, at 7:30 PM, at the Town Hall,  1628 N. Little Ct.,
Janesville, Wisconsin.

1.	Minutes of Previous Meeting
	Moved by Rebout, seconded by Fox, that the minutes of the regular
meeting,           	held February 1, 2016, be approved as presented.
Motion carried on voice vote.	
2.	Financial Report
Moved by Rebout, seconded by Kassel the financial report, ending
February 29, 2016, be accepted as read by Treasurer Augustine. Motion
carried on voice vote. 
3.	Citizen Participation - 
	1. Dennis Schultz, He is still in the process of getting the
Sherriff’s report for 
	  The incident at 3-B’S Bar and Grill on County Rd E. He wants that
place shut 
	  Down does not belong in the Town of Janesville.
4.	Planning Committee Recommendations – 
       A. Moved by Rebout, seconded by Fox, Request from Charles C. &
Ruth E. Rust Rev. 
        Trust, 3870 W. Calle Cinco Green Valley, AZ 85622. 3501 N
Hackbarth Rd Janesville, WI 
        53548. for a zoning change from, Local 
        Commercial District, (B-1) to Exclusive Agricultural District,
(A-2) Section 15-T.3N, R.15E
        SE ¼, NW 1/4, of the 4thP.M.Janesville Township, Rock
County, Wisconsin. 
        Parcel # 6-8-135A.1.  12 m/l acres of the total 38 m/l acres.
Parcel # 6-8-135A.1. Future 
        Zoning of parent lot to remain (B-1). Motion carried on voice
vote.
B. Moved by Kassel, seconded by Fox, request, from Laurie Pernot 2631
N. Polzin Rd Janesville, WI 53548 for a Conditional Use Permit in The
Exclusive Agricultural One District (A-1), for a dog kennel on the
following property:
       Section 19- T.3, R.19 E1/2, E1/2, NW1/4 of the 4TH P.M.,
Janesville Township, Rock 
       County, Wisconsin Parcel # 6-8-173.1 / 6-8-173.  40.24m/l
acres.
       Conditions are as follows: (See attached) the deadline for
these conditions is
	May 2, 2016 with NO extensions. The Board will inspect that the fence
is complete
	And all other conditions are met or the Board may take action to
revoke this Conditional 
	Use Permit. Motion carried on voice vote.
C. Moved by Rebout, seconded by, Fox, request from, James and
Katherine Cullen, 4625 Brentwood Dr. Milton, WI 53563 for a
Preliminary Lot Combination for Lots 8 & 9 High Point Estates, he is
combining 2 lots into Parcel # 6-8-338.103H and 6-8-338.103I total of
6.06 +/- acres. Zoned A-3. Sec. 20. Motion carried on voice vote.
 

5.	Unfinished Business
	A. Moved by Fox, seconded by Kassel, to permit town resident to cut
down or 
	   Dead Trees on Town Property in Juniper Hills. As long as resident
signs the 
	   Release / waiver of the Town. Motion carried on voice vote.
	B. Mary Webster, resident on County Rd A complaint of loud music,
call the 
	  Sheriff’s department we have no ordinance she stated that the
Sheriff’s Dept.
        Said that they are able to play up until 9pm. No action by
board taken.
      C. Moved by Schneider, seconded by Fox, to allow the County to
pick up
  Dead deer in the sensitive areas. Board members can call the County
as 
  Well. Motion carried on voice vote.
D. Discussion on Gaylen Reilly’s property will be on the May 2,
agenda.
6.    	 New Business
	A. Building Inspector Report - 
	B. License Application, Rucks Tree House LLC, Matthew is listed on at
the WI Department of Financial Institute therefore the Rucks Tree
House will not be able to be issued a Class B license that Mindy has
requested. Mel Becker asked how he gets that off his record. We are
not here to advise Matthew Rucks. 
Moved by Rebout, seconded by Kassel, to deny this request for a Class
B license. Motion carried on voice vote. The License expires for 3-B’s
June 30, 2016.
Moved by Fox, seconded by Kassel, to deny the Restaurant License for
Rucks Tree House, LLC. Motion carried on voice vote
Moved by Fox, seconded by Coplien, to deny the Dance License for Rucks
Tree House, LLC. Motion carried on voice vote.
Moved by Fox, seconded by Coplien, to deny the Coin License for Rucks
Tree House LLC. Motion carried on voice vote.
C.	Discussion on the Nature’s Touch Lighting, resident complaint that
it is in his windows and to bright. Todd here to speak on behalf of
Nature’s Touch,
    He said that he has had Alliant Energy out to lower the light 2
times already.    
Resident who made complaint not here. No action taken.
      D. Consider road exemption for Bergendal Septic. No road bans
this year.
      E. Moved by Rebout, seconded by Coplien to approve the operator
license for
  Robert Melchi, Trevor Kelley, Scott Burdick Elizabeth Lehr and
Destiny 
  Harrier, to expire June 30, 2016. Motion carried on voice vote.
	F. Moved by Fox, seconded by Kassel, to consider road exemption for 
        Bergendal Septic, 2015. Motion carried on voice vote.
	G. Discussion on Road Agreement between the Town and Glacier’s Edge
Council
        It has been approved to haul the clay in from Hwy 14 to the
Boy Scout camp, 
	  They have 30 days, we have not heard anything yet. The road is
bonded for 
$900,000.00. Moved by Rebout, seconded by Fox, to give Chairman   
Permission to change the start date if needed, amending the date of
signing. Motion carried on voice vote.
H.  Moved by Fox, seconded by Kassel, to table the delinquent 2015
taxes until 
    April agenda. Motion carried on voice vote.
I. Moved by Kassel, seconded by Fox, to approve Siepert LLP to do a
Review for 2015 books. Motion carried on voice vote.

	A.	Sheriff report- on file with clerk
	 
8.	Vouchers
Moved by Rebout, seconded by Schneider, that Vouchers #89-129 be
approved for payment. Motion carried on voice vote.
9.	Adjournment
	Moved by Schneider, seconded by Kassel, to adjourn. Motion carried
on
      Voice vote.
