MINUTES OF REGULAR MEETING
Town Board
Town of Janesville, Wisconsin
	June 6, 2016

Members Present: Chairman Bruce Schneider, Supervisors David Rebout,
Gary Fox, Janet Kassel and Lon Coplien.

Members Absent:  none

Others Present: Town Clerk Linda Fewell, Treasurer Peggy Augustine,
Constable Archie Henkelmann, Town Attorney Jamie Olson, (16) members
of the public.

Meeting called to order by Chairman Schneider at 7:30 PM, in the Town
Hall, 1628 N. Little Court, Janesville, Wisconsin. 

1.	Pledge of Allegiance
2.	Minutes of Previous Meetings
Moved by Rebout, seconded by Kassel, that the minutes of the regular
meeting, held May 2, 2016, be approved as presented. Motion carried on
voice vote.	
3.	Financial Report
Moved by Fox, seconded by Rebout, the financial report, ending May 31,
2016, be accepted as read by Treasurer Augustine. Motion carried on
voice vote.  
4.	Citizen Participation-
1. Doug Rebout - Invited the Town Board to the Focus on Agriculture
June 29th, 2016.
At MacFarlane Pheasants, Inc. 
2. Dennis Thiele – Complaint of the over grown trees on Burdick Rd. On
agenda.
3. Paul Schiefelbein – wondering if the Board would put “G & I on the
agenda together. Sure.
4. Candidate Sandy Disrud – Running for Register of Deeds, introduce
herself.
5. Deputy from the Sheriff’s Department here comments, questions,
concerns or compliments.  
Janet Kassel - asked what size trucks are allowed on County Rd H? No
limit.
Lon Coplien – asked how the officer was doing after an accident. Doing
better.                                                         
5.	Planning Committee Recommendations – all approved by planning and
zoning.
	1. Request from Raymond Gehrig, 5110 N Connor Rd, Janesville, WI. For
an 
	Additional Conditional Use Permit to change the hours of operation
at, 
	Gehrig Clubs, LLC. Hours of operation during daylight savings time on
Sundays from 
10:00am until 3:00pm and Tuesdays from 3:00pm until dark with no
additional conditions. Moved by Fox, seconded by Coplien, to approve
this Conditional Use 
Permit. Motion carried on voice vote.
2. Request from Nicholas Speer, 2822 N West River Dr. Janesville, WI.
For a
Zoning Change from (A-1) to (SFRR) .37 acres +/-.Moved by Fox,
seconded by Rebout,
To approve the zoning change from A-1 to SFRR. Motion carried on voice
vote.
3. Request from John and Diane Speer, 2614 NW River Dr. Janesville WI
53548For a transfer of land between adjacent lots, landowners property
2.49 acres, Transfer area of acres 0.4 acres. Section 15, Parcel #
6-8-141.002. Current zoning of receiver lot A-1, current zoning of
parent lot SFRR, future zoning of parent lot SFRR. 
Moved by Fox, seconded by Schneider, to approve the transfer of land
between adjacent lots as presented. Motion carried on voice vote.
A. Moved by Rebout, seconded by Coplien, to approve the Amending
Single Family Rural Residential District (SF-RR) 15ft. rear setback
and 8ft side setback. Motion carried on voice vote. 
B. Discussion regarding the Countryside Motel, property is zoned A-3,
taxed as commercial (the use). Owner has to ask for be zoned getting
one will be difficult.
C. Moved by Rebout, seconded by Fox, to approve the request for a
preliminary lot combination for Brad and Carmen Pernot 5828 N Timber
Ridge Dr. Zoning will remain (SFRR). Motion carried on voice vote.
D. Moved by Rebout, seconded by Fox, to approve the request to
transfer land between adjoining owners, Karen Hirsch 2801 W Deer Path
Trail and David Rezin, 4452
N. River Rd transferred area 500 sq. ft. zoned SFRR. Motion carried on
voice vote.
E. Moved by Coplien, seconded by Schneider, to approve the request to
transfer land between adjoining owners, Karen Hirsch 2801 W Deer Path
Trail and Neal Schneider, 4460 N. River Rd transferred area 1600 sq.
ft. zoned SFRR. Motion carried on voice vote.
F. Bruce Schneider stepped down for this vote. Final plat for Bruce
Schneider, 12 lots sitting on leased land on private road. Department
of Transportation would not approve this to be a public town road,
would have to access County Rd E. Lon questioned wasn’t there to be a
new road? No, there are no new driveways. Also a lot of these houses
are in the flood plain, houses could be re-built but may have to be
raised up.
Moved by Fox, seconded by Kassel, to approve the final plat for Bruce
Schneider
3001 W Hwy 14, Janesville, WI. Motion carried on voice vote. Bruce
stepped back in.
6.	Unfinished Business-
	A. Noise complaint on County Rd A- no complaints this month. Remove
from agenda at
        this time.
B.  Moved by Kassel, seconded by Schneider, to not change the status
of the A-1FP to 
An overlay of any other action at this time. Residents can request the
change and the Planning and Zoning can due on a case by case basis.
There must be a meeting scheduled
For the change of any land. This would be for all of 2016. Motion
carried on voice vote.
7.	A.  Building Inspector Report – All running smooth.
	B.  Moved by Fox, seconded by Coplien, to set the next 6 Town Board
Meetings for, July 5, Aug. 1, Sept.6, (Tuesday) Oct. 3, Nov. 1
(Tuesday) and Dec. 5, 2016 all to begin at 7:30pm in the Town Hall at
1628 N. Little Ct. Motion carried on voice vote.	
C.   License Applications
	1.   Class A Combination                           
Moved by Rebout, seconded by Fox, that the application, by Agent James
Johnson, for a Class A Combination Fermented Malt Beverage and
Intoxicating Liquor License at Lions Quick Mart, expiring June 30,
2017, in the Town of Janesville be approved. Motion carried on voice
vote.
	 2.  Class B Combination
Moved by Fox, seconded by Schneider, that the applications, by agent
Lance Marting, at The Janesville Country Club, for Combination Class B
fermented Malt Beverage and Intoxicating Liquor License within the
Town of Janesville, expiring June 30, 2017, in the Town of Janesville
be approved with extensions. Motion carried on voice vote 
Moved by Fox, seconded by Schneider, that the applications, by agent
Julie Golomski, at Shady Nook, for Combination Class B fermented Malt
Beverage and Intoxicating Liquor License within the Town of
Janesville, expiring June 30, 2017 be approved with extensions. Motion
carried on voice vote.
Moved by Fox, seconded by Schneider, that the applications, by agent
Kurt & Mary Helgesen, at Helgesen’s Supper Club on Eleven for
Combination Class B fermented Malt Beverage and Intoxicating Liquor
License within the Town of Janesville, expiring June 30, 2017 be
approved with extensions. Motion carried on voice vote.
Class B Combination 
Moved by Fox, seconded by Rebout, that the application, by agent:
Melvin Becker,   Denied renewal, for a Combination Class B fermented
Malt Beverage and Intoxicating Liquor License within the Town of
Janesville, Mel Becker not in control of the property,
Perceived owner is a habitual law offender and has been violation and
/ or convicted of several felonies. Motion carried on voice vote.
	3.  Coin Machine License
Moved by Kassel, seconded by Fox, that the applications, agent Julie
Golomski, at Shady Nook, and agent Kurt & Mary Helgesen at Helgesen’s
Supper Club on Eleven, for coin machine license, expiring June 30,
2017 be approved. Motion carried on voice vote.
Moved by Kassel, seconded by Fox, that the applications, agent, Melvin
Becker, For Coin Machine License Denied renewal not in control of the
property,
Perceived owner is a habitual law offender and has been violation and
/ or convicted of several felonies. Motion carried on voice vote. 
	4.  Restaurant License
Moved by Fox, seconded by Kassel, that the applications, by agent,
Julie Golomski at Shady Nook, agent James Johnson, at Lions Quick
Mart, agent Lance Marting at Janesville Country Club, agent Kurt &
Mary Helgesen, at Helgesen’s Supper Club on Eleven, for restaurant
license, expiring June 30, 2017 be approved. Motion carried on voice
vote.
Moved by Fox, seconded by Coplien, that the applications, agent,
Melvin Becker, For Restaurant License Denied renewal not in control of
the property,
Perceived owner is a habitual law offender and has been violation and
/ or convicted of several felonies. Motion carried on voice vote. 
	5.  Dance License
Moved by Kassel, seconded by Schneider, that the application, by agent
Lance Marting at Janesville Country Club, for a dance license,
expiring June 30, 2017 be approved. Motion carried on voice vote.
	6.  Cigarette License
Moved by Fox, seconded by Coplien, that the applications, by agent
James Johnson at Loins Quick Mart and agent Julie Golomski at Shady
Nook, for a cigarette license, expiring June 30, 2017 be approved.
Motion carried on voice vote
D.  Operator License (attached)
Moved by Fox, seconded by Rebout, to approve all the license
applications for operator license to expire June 30, 2017 as presented
by clerk Fewell. Motion carried on voice vote.
E. Discussion and possible action on Road Maintenance Projects,
Edgewood Dr. going to file with the Insurance Company of Kerry Hull
Farms for the damage done by farm equipment. Seal coating Rockport Rd,
Brown Deer, Brown View. 
Mineral Point Rd beginning at Phal Rd. End at Willowdale Rd,
282,000.00.
Town Parking lot, Tree and brush trimming, quite a bit all around that
needs to be done.
Approx.: cost of the tree & brush trimming $15,000.00 Also that we do
250 Tons of grader patch cost $20,800.00, this does not include our
winter maintenance and regular monthly road work.
Moved by Schneider, seconded by Fox, to approve the County to do Road
Maintenance Projects. Motion carried on voice vote.
F. Moved by Rebout, seconded by Fox, to approve for the Town to pay
for the gate and lumber to make sign for Mt Pleasant Cemetery. Motion
carried on voice vote.
G. & I. Discussion and possible action on the Mt Pleasant Cemetery
ingress and egress.
Paul Schiefelbien, was here and presented a letter (on file), speaking
on behalf of his grandparents Ray and Carol Schiefelbien regarding the
cemetery. The Schiefelbien’s feel that there needs to be “guidelines”
for the cemetery and the public that visit. Town will have a sign for
the visitors to stay on the existing driveway and if going to visit to
pull fully into the cemetery. While this has been a long discussion it
has been tabled for July.
Moved by Kassel, seconded by Fox, to table this cemetery issue till
the July meeting.
Motion carried on voice vote.
H. Discussion and possible action on 4416 N. River Rd, compliant of a
“junk” yard. Archie has taken a look and reported that it is not a
junk yard. No action at this time.
J. Discussion and possible action on complaint at 3-B’s of cut trees,
debris and running a tree business out of the pavilion.
Moved by Rebout, seconded by Kassel, to have Clerk Fewell will send a
letter to Mel Becker and Matthew Rucks. Motion carried on voice vote.

   
8.	Reports by Town Attorney- nothing to report on.
	
9.	Correspondence
	A. Sheriff’s Report- May report on file with clerk.
10.	Vouchers		
Moved by Rebout, seconded by Fox, that Voucher #202 through 220 and
222 through 226 be approved for payment. Motion carried on voice
vote.
11.	 Adjournment
	Moved by Fox, seconded by Kassel, to adjourn. Motion carried on voice
vote.
