MINUTES OF REGULAR MEETING
Town Board
Town of Janesville, Wisconsin
	June 5, 2017

Members Present: Chairman Bruce Schneider, Supervisors David Rebout,
Gary Fox, Janet Kassel and Lon Coplien.

Members Absent:  none

Others Present: Town Clerk Linda Fewell, Treasurer Peggy Augustine,
Constable Archie Henkelmann, Town Attorney Jamie Olson, (25) members
of the public.

Meeting called to order by Chairman Schneider at 7:30 PM, in the Town
Hall, 1628 N. Little Court, Janesville, Wisconsin. 

1.	Pledge of Allegiance
2.	Minutes of Previous Meetings
Moved by Rebout, seconded by Kassel, that the minutes of the regular
meeting, held May 1, 2017, be approved as presented. Motion carried on
voice vote.
Moved by Fox, seconded by Kassel, that the minutes of the special
meeting regarding the trash and recycling contracts held May 8th,
2017, be approved as presented. Motion carried on voice vote.
3.	Financial Report
Moved by Rebout, seconded by Fox, the financial report, ending May 31,
2017, be accepted as read by Treasurer Augustine. Motion carried on
voice vote.  
4.	Citizen Participation-
1. Sheila Everhart W. Cty Rd A – ABC neighborhood watch: Cty Rd A,
Burdick Rd. Facebook, text. Who do we complain to for the tall grass
on Hwy 14 and Burdick Rd? There was almost a head on crash there this
morning. Also wondering about reducing the speed on Cty Rd A. Not
going to happen it is based on the number of driveways.
2. David Rebout- John Reilly wants final viewing of the fence and
start the next section. Town wants proof of receipts of the first
fence building. David will let John know.
3. Gaylen Reilly- What’s his issue? State Statues chapter 90.03 spells
out cattle fencing.
4. Deputy Nolan from the Rock County Sheriff’s Department here for
comments and questions. Janet Kassel said traffic on County Rd H from
County Rd A to Mineral Point Rd is always speeding.                   
                                      
5.	Planning Committee Recommendations – all approved by planning and
zoning.
A. Request from Circle R Ranch LLC, 2520 Linden Avenue Janesville WI
53548,    reference address: 2338 W. Russell Rd Janesville WI 53535.
For a Preliminary Minor Land Division, 61 acres zoned A-1FP, land
division Area 11 +/- acres, future zoning of new lot A-2. Future
zoning of parent lot to remain A-1 FP. This request was tabled by the
Planning and Zoning Committee. No action by board required.



B. Request from Rollingwood Development Inc. C\O Christine Hudson 614
N. Pine St. Janesville WI 53535. For a Land Division, 25 acres +/-
zoned B-1, new lot division will be 2 acres +/- zoned B-1. Future
zoning of parent lot will remain B-1. Parcel 6-8-23.1
Moved by Fox, seconded by Kassel, to approve this request. Motion
carried on voice vote.
C. Request, from Gary Hergert, 320 E J-F Townline Rd for a change in
zoning / Land Division from Exclusive Agricultural District (A-1) to
(A-2) 15+/- acres, and a Land Division of 2.0 acres +/- with a rezone
of SFRR. And a 700 sq. ft. to SFRR. Parcel # 6-8-4.6 & 6-8-4.6A. Moved
by Rebout, seconded by Kassel, to approve this request. Motion carried
on voice vote.  
D. Discussion and possible action regarding map error on the Leyden
Store 6421 Hwy 14 Janesville, WI 53548. Map shows SFRR, nowhere can we
find where it was rezoned at Town or County level from (B-1 to SFRR).
Moved by Fox, seconded by Kassel, to approve this request. Motion
carried on voice vote.
6.	Unfinished Business-
	A. Report regarding 3761 Harvest View Dr. Dog issue all resolved.
B. Report regarding light issue on Rockport Rd. board sees no problem,
closed issue.
C. Report regarding the Town Audit. No questions from the Board,
closed. 
New Business
7.	A.  Building Inspector Report – All good.
	B.  Moved by Rebout, seconded by Fox, to set the next 6 Town Board
Meetings for, July 10, Aug.7, Sept.5, (Tuesday) Oct. 2, Nov.6 and Dec.
4, 2017 all to begin at 7:30pm in the Town Hall at 1628 N. Little Ct.
Motion carried on voice vote.		
C.   License Applications
	1.   Class A Combination                           
Moved by Rebout, seconded by Coplien, that the application, by Agent
James Johnson, for a Class A Combination Fermented Malt Beverage and
Intoxicating Liquor License at Lions Quick Mart, expiring June 30,
2018, in the Town of Janesville be approved. Motion carried on voice
vote.
	 2.  Class B Combination
Moved by Fox, seconded by Coplien, that the applications, by agent
Lance Marting, at The Janesville Country Club, for Combination Class B
fermented Malt Beverage and Intoxicating Liquor License within the
Town of Janesville, expiring June 30, 2018, in the Town of Janesville
be approved with extensions. Motion carried on voice vote 
Moved by Fox, seconded by Coplien, that the applications, by agent
Julie Golomski, at Shady Nook, for Combination Class B fermented Malt
Beverage and Intoxicating Liquor License within the Town of
Janesville, expiring June 30, 2018 be approved with extensions. Motion
carried on voice vote.
Moved by Fox, seconded by Coplien, that the applications, by agent
Kurt & Mary Helgesen, at Helgesen’s Supper Club on Eleven for
Combination Class B fermented Malt Beverage and Intoxicating Liquor
License within the Town of Janesville, expiring June 30, 2018 be
approved with extensions. Motion carried on voice vote.
Class B Combination 
Moved by Fox, seconded by Coplien, that the application, by agent:
Megan Williams Tree House Bar and Grill, for a Combination Class B
fermented Malt Beverage and Intoxicating Liquor License within the
Town of Janesville, expiring June 30, 2018 be approved with
extensions. Motion carried on voice vote.
	3.  Coin Machine License
Moved by Fox, seconded by Coplien, that the applications, agent Julie
Golomski, at Shady Nook, agent Kurt & Mary Helgesen at Helgesen’s
Supper Club on Eleven and Agent Megan Williams, Tree House Bar and
Grill for coin machine license, expiring June 30, 2018 be approved.
Motion carried on voice vote.
4.  Restaurant License
Moved by Rebout, seconded by Coplien, that the applications, by agent,
Julie Golomski at Shady Nook, agent James Johnson, at Lions Quick
Mart, agent Lance Marting at Janesville Country Club, agent Kurt &
Mary Helgesen, at Helgesen’s Supper Club on Eleven and agent Megan
Williams, Tree House Bar and Grill, for restaurant license, expiring
June 30, 2018 be approved. Motion carried on voice vote.
	5.  Dance License
Moved by Fox, seconded by Coplien, that the application, by agent
Lance Marting at Janesville Country Club, agent Megan Williams, Tree
House Bar and Grill, for a dance license, expiring June 30, 2018 be
approved. Motion carried on voice vote.
	6.  Cigarette License
Moved by Rebout, seconded by Kassel, that the applications, by agent
James Johnson at Loins Quick Mart and agent Julie Golomski at Shady
Nook, for a cigarette license, expiring June 30, 2018 be approved.
Motion carried on voice vote
D.  Operator License (attached)
Moved by Rebout, seconded by Fox, to approve all the license
applications for operator license to expire June 30, 2018 as presented
by clerk Fewell. Motion carried on voice vote.
E. Moved by Rebout, seconded by Coplien, to approve the 3-year
contract with John’s Disposal. They will start dropping off the totes
week of June 19th, 2017. Totes from Advance will be collected by
Advance on June 29th, 2017, John’s Disposal will add to the contract
the 120 days to opt out of the contract if they sell out. Also that
John’s will do the balance count with the clerk by October 30, of each
year. Smaller totes can be ordered by the residents after all totes
have been distributed. Motion carried on voice vote.
F. Moved by Fox, seconded by Kassel, to approve the Town Ordinance #
170605.1 Confidentiality of Income and Expense Records in the Town of
Janesville. Motion carried on voice vote.
G. Moved by Fox, seconded by Coplien, to approve the Town Ordinance #
170605.3 establishing a Procedure for Criteria for Allowing
Alternative Forms of Sworn Testimony at Board of Review Hearings in
the Town of Janesville. Motion carried on voice vote.
H. Moved by Kassel, seconded by Rebout, to approve the Town Ordinance
# 170605.2
Establishing a Procedure for a Waiver of Board of Review Hearing
Requests (telephone testimony). Motion carried on voice vote. 
I. Moved by Fox, seconded by Coplien, to table the complaint of too
many horses at 2320 Dani Dr. 6.34 acres allow to have no more than 6
horses. Tabled for 60 days will be on the August 7th, 2017 agenda.
Will have to apply for a conditional use permit or they will possible
purchase 25acres so they can have the horses. Was brought up they have
2 unlicensed dogs as well. Motion was 4 in favor 1 opposed, carried.
J. Moved by Schneider, seconded by Rebout, to have Peggy and Gary work
with the County to lay out a plan and try to come to a plan and
negotiate a payments for the unpaid bill in 2009. Must have gotten
missed as the previous clerk was going out and the new clerk was
coming in to office. Motion carried on voice vote.
K. Complaint from residents on Edgewood Dr. chip sealing the road is
unsafe for kids, bikes. Residents would like the slurry instead of
chip sealing. Chairman Schneider said that costs about $12,000.00 more
and the Town cannot afford that. Chairman Schneider will talk to the
County to see if they can clean it up better after finishing.
L. Moved by Fox, seconded by Coplien, to approve the Resolution
#170605.1 to approve the borrowing of $300,000.00 for the period of
one (1) year to provide fire protection for the Town of Janesville.
The resolution was read aloud by Chairman Schneider. Motion carried on
voice vote.
Moved by Fox, seconded by Coplien, to approve the Form of Record
presented and read aloud by Chairman Schneider for the purpose of
borrowing money for the Town of Janesville’s Fire Protection. Motion
carried on voice vote.
M. Duane Jorgenson, here from Rock County to talk about the Federal
Aide for the Polzin Rd Bridge. The rating on the bridge is at 20.4 it
qualifies for federal aid. We have a July 10th, 2017 deadline for the
application. Duane will draw up the final numbers and we will have a
“special meeting” to approve the application. Should we chose a box
culvert we would not be eligible for the Bridge Aide.
Moved by Schneider, seconded by Fox, to have a “special meeting” on
June 22nd, 2017 at 5:00 pm here in the Town Hall to approve the
application. Motion carried on voice vote.
John Rielly- here to request a final fence viewing for his property at
2905 N. Burdick Rd.
The Town has requested a receipt or cancelled check as proof of the
payment for the fence before we send out the Partition Fence
Certificate. No action required on this information only. We will wait
for the requested information. 
   
8.	Reports by Town Attorney- nothing to report on.	
9.	Correspondence
	A. Sheriff’s Report- May report on file with clerk.
10.	Vouchers		
Moved by Rebout, seconded by Fox, that Voucher #175 through 204 be
approved for payment. Motion carried on voice vote.
11.	 Adjournment
	Moved by Fox, seconded by Kassel, to adjourn. Motion carried on voice
vote.
