MINUTES OF REGULAR MEETING
Town Board
Town of Janesville, Wisconsin
July 10, 2017

Posted: Thursday, June 30, 2017 at the town office, Lion's Quick Mart,
Consolidated School and the Town Website.
Members Present: Chairman Bruce Schneider, Supervisors Gary Fox, Janet
Kassel and Lon Coplien
Members Absent: Supervisor David Rebout and clerk Linda Fewell
Others Present:  Treasurer Peggy Augustine, Attorney Jamie Olson,
Constable Archie Henkelmann, (18) members of the public. 

Meeting called to order, by Chairman Schneider, at 7:30 p.m., at the
Town Hall, 1628 North Little Court Janesville, Wisconsin, followed by
the pledge of allegiance.

1.	Minutes of Previous Meeting
Moved by Fox, seconded by Coplien, that the minutes of the regular
meeting, held June 5, 2017, be approved as presented Motion carried on
voice vote.
2.	Financial Report
   	Moved by Fox, seconded by Kassel, to approve the financial report
ending 	June 30, 2017 as presented by Treasurer Augustine. Motion
carried on voice vote.  
3.	Citizen Participation
	A. Neighbor of Bruce Schneider has been shooting, Bruce has talked to
them and 
	It appears to be resolved.
B. Chairman Schneider brought up Pahl Road the culvert is washed out
and needs to be replaced. Bruce talked with the County and the
estimated cost would be about $15,000.00. This issue will be looked
into and talked about.
C. Chairman wants a breakdown of the budget to see where we are
sitting for 
Road work. To be on the August agenda.
D. Gary Fox, talked to Trey from Advanced Disposal his and his
neighbor’s totes did not get picked up. Trey said that they will send
out a pickup to get the totes on Leith Road. Peggy told them what
Jason said, that they (Advanced Disposal) would be pick up the totes
from the Town Hall after July 14, 2017 and no cost was mentioned
4.	 Recommendation from Planning & Zoning Committee – Did not meet
5.	Unfinished Business	
6.	New Business 
       A. Building Inspector Report- Copies handed out to board
members.                                       
B. Moved by Fox, seconded by Kassel, to approve the Resolution 
# 170710.0 Adopting Policy Regarding the Building, Repairing, and
Rebuilding
Of Partition Fences Per. WI Stat. Ch. 90. Gary wants to add fences
where land owners do not agree on the payment required in Chapter 90,
then it would be recorded at the Town Hall level. Motion carried on
voice vote.
C. Moved by Kassel, seconded by Coplien, to approve the Resolution #
170710.2 Establishing Fees for Fence Viewers Per. WI Stat. sec. 90.15.
An example of Green County Resolution showed $40.00 a day or $10.00
per hour.
Board chose the $10.00 per hour and cannot include legal fees. Motion
carried on voice vote.
D. Moved by Fox, seconded by Coplien, to approve operator license for
Jaycee Martin, Mark Boufford, Ashley Bovenmyer, Jessica Montalvo,
Kenneth Frisque, Roberta Rhodes and Ellen Hemenway all to expire June
30, 2018. Motion carried on voice vote.	 
E. Complaints regarding Tree House Bar & Grill, Sherry Gensler- the
noise is worse than it has ever been even when it was 3-B’s. Service
doors on the pavilion are wide open, music is loud, foul language over
microphones that is heard throughout the neighborhood. The minutes
indicated that the pavilion would be used for weddings and graduation
parties, but it is being used every weekend.
Sheila Everhart requested that the letter be read aloud, so Chairman
Schneider read the letter.
Megan Williams was present with Attorney Warner who questioned dates
and times of the loud music. 
Gary Fox requested that recordings be played, Attorney Warner again
questioned dates and if Sheriff was called. No citations were issued.
Neighbors cannot enjoy their quiet homes because the music is too loud
as early as 5:00pm.
Several residents are nurses and work early in the morning or 3rd
shift and are not getting any rest.
Monday – no noise
Tuesday – every other is bike night.
Janet asked for Tree House input, Attorney Warner, states that no
neighbors have complained to the Tree House, no citations have been
issued. He has ALL the Sheriff’s reports. Tree House wants to work
with the neighbors. 
Sherry Gensler- there was not a problem last year so there was no
reason to be here for the renewal of the liquor license. Other
citizens got up and spoke on the issue of the noise.
Megan- says music is only for 3-8 hours.
Sherry- Tuesday bike nights are from 6pm-10pm
Megan- Sheriff’s department gets sick of coming out on all the calls.
Bruce- We need a compromise!
Megan- there are times she thinks it’s too loud- says band will turn
it down
Sherry- if Sheriff comes out then music goes down, but back up after
they leave
Megan- says port a potties are ok per the health department.
Attorney Jamie Olson- stated that foul language in video is grounds
for pulling liquor license, being loud.
Lon- we have 20 days left in July to get this issue resolved or move
to revoke license.
Jamie – read Sheriff’s reports
Janet – wants neighbors to call the Tree House and let them know noise
is too loud, Attorney Warner agrees.
They will have 20 day to come to a compromise, together or the license
will be revisited. Board members are encouraged to visit Tree House at
different times in the next 20 day window and give report at the
August 7th, 2017 meeting. This will be on the Town Board Agenda.
Tabled until August.

9.	Correspondence
	A. Sheriff’s Report- May report on file with clerk.
10.	Vouchers		
Moved by Fox, seconded by Coplien, that Voucher #205 through 236 be
approved for payment. Motion carried on voice vote.
11.	 Adjournment
	Moved by Coplien, seconded by Kassel, to adjourn. Motion carried on
voice vote.
