MINUTES OF REGULAR MEETING
Town Board
Town of Janesville, Wisconsin
September 5, 2017

Posted: Friday, September 1, 2017 at the Town Hall, Lion's Quick Mart,
Consolidated School, and town web site. 
Members Present: Chairman Bruce Schneider, Supervisor David Rebout,
Gary Fox, and Lon Coplien.
Members Absent: Janet Kassel. 
Others Present:  Town Clerk Linda Fewell, Treasurer Peggy Augustine,
Town Attorney Jamie Olson, and Archie Henkelmann (11) members of the
public.
Meeting called to order by Chairman Schneider at 7:30 PM., at the Town
Hall, 1628 N. Little Court, Janesville, WI, followed by the pledge
allegiance.
1.      Minutes of Previous Meeting
 Moved by Fox, seconded by Coplien, that the minutes of the regular
meeting, held August 7th,   
 2017 be approved. Motion carried on voice vote.
Minutes of the Board of Review
Moved by Rebout, seconded by Coplien, that the minutes of the Board of
Review held June 5th, 2017 and June 22nd, 2017 be approved as
presented. Motion carried on voice vote.
2.	Financial Report
Moved by Fox, seconded by Rebout, that the financial report ending
August 31, 2017, be    accepted as read by Treasurer Augustine. Motion
carried on voice vote. 
3.	Citizen Participation- 
Karl Skinner- 3501 N. Hackbarth Rd brought up concern about all the
smoke coming from the former Bruce Monson property. He called Archie
Henkelmann to see if residents are allowed to burn on a continual
basis. Also he called the non- emergency number and a fire truck was
dispatched. 
Lon Coplien – Followed a Rucks Tree Service truck onto the former
Bruce Monson property and watched him dump a truck load of logs on a
fire that was already burning. He told this young man that that cannot
do that, the young man replied that he is only doing what he was told.
Lon told this guy to get Matthew Rucks on the phone. Lon told Matthew
that he cannot bring brush and logs onto the property to burn. Also
there is about 12 big trucks parked on the property.
Nate Stapelton – 3372 N. Hackbarth Rd. wondering if Rucks is allowed
to run a business on that property? No, he cannot run a business on
that property. He has been burning a pile nonstop for about a month.
Rucks got into the face of Mr. Banasinski 3377 N. Hackbarth Rd. over
the smoke issue. 
Peggy Augustine – treasurer mentioned that Parker Credit Union is
merging with Educators Credit Union. They will try to work with us for
the amount of checks we have on hand, so it will not cost us to have
to change them out. 
Also Peggy mentioned about the Public Works billing from the County
was the materials only for Polzin Rd. $174,500.00 that does not
include labor and tools. We will call Duane to ask about the trip
funds. The credits have all gotten eaten up so let the rest ride for
now.
Bruce Schneider – Chairman mentioned the Fox Den (Jeff Fox) putting
the 1st and 2nd lift on the N. Hackbarth Rd N. of Hwy 14 this fall and
the 3rd lift can be in the spring of 2018. Clerk Fewell to send a
letter to Jeff Fox and Ron Combs.
Sheila Everhart- 4618 County Rd A Local Town and Government should
regulate and follow the Ordinances, Town’s Association has ordinances.
Sheila is representing the children in the neighborhood of the Tree
House, she feels the board in not doing their job enforcing the
ordinances. It also lowers property values. Lon and Gary have been out
at the Tree House and fee that the music was too loud, Lon went into
one of the homes and stated it was very loud.
Sherry Gensler-3348 N. Cty Rd E she presented text message in writing
and feels the neighbors are working with them, and it is still too
loud. Not of the agenda No action taken. Brook Stapelton called to
Sheriff’s department. This will be a follow up on the October agenda.
Dale Prebe- 3705 n. Harvest View explained that he lived next door to
a band and they complained so the band moved to the basement, no more
complaints. Dale went to the Tree House and said the decibels in
pavilion was 90, on the road decibels were 70 and cars going by were
60. He asked why neighbors don’t meet with bar? Sherry stated we have
been talking since day one. Dale stated you have not sat down with the
bar owners to try and work things out.
Gary Fox- Supervisor, talked to Colin at the County and said they are
about 60% done with the fire numbers. 
4. 	Committee Recommendations-	
A. To hear a request, from Greg Gensler 3348 N. County Rd E,
Janesville,   WI 53548 for a Rezone at 3328 N. Hackbath Rd .530acres
+/-, current zoning of land (A-1), future zoning change from (A-1) to
(SFRR). On the property as follows:
PT GOVT LOT 3 COM 146. 1’ E OF NW COR, SE 148.5’, E 127.5’, SE 265’,
NW173.4’ NW 131.3’, N 128.5’, NW 133.8’ TO POB (EXC COM N COR S
2807.76 TO POB, SELY 2.94’ SWLY 169.9’, N58.12’, E 164.11 TO POB)
Section 15, T.3N, R.12E, of the 4th P.M.., Janesville Township, Rock
County, Wisconsin. Parcel # 6-8-142.1 /Tax ID 016 015041. 40,000 sq.
ft. is the min lot size for SFRR, Grandfathered in built before 1994,
duplex allowed on A-1 because it is grandfathered.
Greg Gensler -3328 N. Hackbarth Rd. Planning and Zoning recommended to
the Town Board that Greg Gensler withdrew this application. Moved by
Fox, seconded by Rebout, to accept his request. Motion carried on
voice vote.
	
B. To hear a request, from Greg Gensler 3348 N. County Rd E,
Janesville, WI 53548 for a Rezone at 3372 N. Hackbath Rd. 9.290 acres
+/-, current zoning of land (A-1), create new lots future zoning
change from (A-1) to (SFRR). On the property as follows:

FOR POB, SE 182.3’,SE TO PT, N TO N R/W RD, N 128.5’, NWLY 133.8’, N

RD, S & SELY TO POB ( EXC COM N COR S 2807.76’, SELY 2.94’, SWLY
169.9’ TO POB, NWLY 191.48’, SELY 133.98’, S 58.62 TO POB) Section 15,
T.3N, R.12E, of the 4th P.M.., Janesville Township, Rock County,
Wisconsin. Parcel # 6-8-142 / Tax ID 016 015040
Planning and Zoning recommended to the Town Board that this request
was tabled for up to one year with a regular scheduled meeting. Greg
wants to sell and homes built on 4 parcels. The commercial building
will be turned into a residence.Greg needs to have the land surveyed
and a certified survey map of the parcels that he is planning on
creating. Moved by Rebout, seconded by Coplien, to table this request
until a CSM can be brought in on the plan for the land. Motion carried
on voice vote.
5.	Unfinished Business
Moved by Fox, seconded by Coplien, to table the Discussion and
possible action on the Town having a “maintenance” man that would
oversee the need for maintenance in the Town. David was unable to get
a hold of John Traynor. Motion carried on voice vote.  
6.	New Business	
	A. Building Inspector Report-	  
B. Moved by Fox, seconded by Coplien, to approve operator license for
Crystal McCauley, to expire June 30th, 2018. Motion carried on voice
vote.
	C. Moved by Fox, seconded by Coplien, to approve a resolution for the
2018 Clean Sweep
 Program and budget $500.00 toward the program. Motion carried on
voice vote.	
D. Moved by Coplien, seconded by Fox, to table the fence issue between
Reilly and Sheridan,
Board wants more information, Reilly needs more proof on how the
certificate was handled. Board wants an itemized statement on the
fence cost, copy of the bid / statement and that the certificate was
sent certified. Attorney will draw up a letter so all these things are
listed and clerk will mail copy to Mr. Reilly. This will be on the
October agenda. Motion carried on voice vote.

9.	Vouchers
      Moved by Rebout, seconded by Coplien, that Voucher #259 through
and including #286 be  
      Approved for payment. Motion carried on voice vote.
10.    Adjournment
       Moved by Rebout, seconded by Fox, to adjourn. Motion carried
on
       Voice vote. Meeting adjourned at 9:12pm.
