MINUTES OF REGULAR MEETING
Town Board
Town of Janesville, Wisconsin
November 6, 2017

Posted:  Friday, November 3rd, 2017 at the town office, Lion's Quick
Mart, Consolidated School, and town website. 

Members Present: Chairman Bruce Schneider, Supervisors David Rebout,
Gary Fox, Janet Kassel and Lon Coplien.
Members Absent: none
	  
Others Present:  Town Clerk Linda Fewell, Treasurer Peggy Augustine,
Town Attorney Jamie Olson, Constable Archie Henkelman, (26) members of
the public.

Meeting called to order, by Chairman Schneider, at 7:30 p.m., at the
Town Hall, 1628 N. Little Court, Janesville, WI. Followed by the
pledge allegiance.
 1.	Minutes of Previous Meeting
Moved by Fox, seconded by Coplien, that the minutes of the regular
meeting held October 2nd, 2017 approved with the correction of page 2
under “c” add wood burning on the property. Motion carried on voice
vote, with the noted correction.
Moved by Fox, seconded by Coplien, that the minutes of the special
budget working session held on October 5th, 2017 be approved as
presented. Motion carried on voice vote.
Moved by Fox, seconded by Coplien, that the minutes of the special
meeting for the TRIP / LRIP funds for the grant money held October
12th, 2017 be approved as presented. Motion carried on voice vote.
 2.	Financial Report
     	Moved by Rebout, seconded by Fox, that the financial report,
ending 
October 31, 2017, be accepted as read by Treasurer Augustine. Motion
carried on
Voice vote.
3.   Citizen Participation - None
	
4.  Planning Committee Recommendations –
A. To hear a request, from Brad and Jeana Thom 6426 W Hwy 14
Janesville WI. 53548 For a Zoning Change from SFRR to B-1 for a Beauty
Salon at the address of 6527 W US Hwy 14 Janesville, WI 53548 .26
acres +/- section 18-3-12. Zoned SFRR. To cut hair and offer beauty
salon products for sale. No one here to speak in favor or against.
Gary Fox asked when they were going to open for business. Response was
January 1st 2018. Planning and zoning approved.
Moved by Fox, seconded by Coplien, to approve this recommendation from
the planning and zoning committee to change zoning from SFRR to B-1.
Motion carried on voice vote.
	 
5.	Unfinished Business - None
 
6.    New Business
      A. Building Inspector Report – 3 new dwellings this week.
B. Porsche Kettelhut 2320 N. Dani Dr. requesting an extension to rid 2
horses on her property. She is in violation of the Town Ordinance she
has 8 horses on two parcels 3.19acres and 3.15 acres. She is allowed 6
– 1 large animal per acre. Porsche is not here to speak of her
request. Greg Neumann, Britt Rd speaks against her request. She is not
here no action required, she has until the original date of November
30th, 2017 to rid of two horses to be in compliance with Town
Ordinance. Fees will occur as expected on the 1st of December, 2017 if
the horses are not gone by November 30th, 2017.
C. Discussion on Matthew Rucks running a business on his property
6-8-135.13 Hackbarth Rd. Chairman Schneider said it is cleaned up,
Supervisor Rebout said it is cleaned up. Coplien asked how many trucks
are out there tonight. Rucks replied 7 or 8, Coplien asked what does
that mean running a business. Rucks stated that there is nothing in
the ordinance that says you can or can’t park trucks on A-3 property.
Sherry Gensler- speaking for Mrs. Banaski she is not able to attend
due to child care. People are coming and going from the property,
trucks being parked there for work. Rucks responded there is NO logs,
NO burning it is all cleaned up. Its trucks being parked there. Janet
Kassel asked is just parking the trucks not a business? Amber adjacent
to his property. There is lots of traffic daily. Rucks stated, Bruce
Monson had lots of stuff parked out there. I have cleaned it up and
looks a lot better. It is not a business just parking trucks out there
early AM and PM show me where I cannot park trucks on my property.
Supervisor Rebout does not find that parking licensed vehicles on your
property is wrong. Nothing black and white that he cannot park them
there. No action required, nothing can be done. Closed.  
D. Discussion regarding a letter from the County to Matthew Rucks,
notice of noncompliance- Rock county Shore land and flood plain zoning
ordinance. Bruce read the letter allowed, clerk has the letter in the
office on file. Supervisor Coplien asked Rucks if he wanted to
explain, he said I don’t have too, have you been down there! 
E. Moved by Rebout, seconded by Fox, to approve the operator licenses
for Ryan Scheiber and Heather Langer, to expire June 30, 2018. Motion
carried on voice vote. 
F. Discussion on the JIRP road program- Gary put in all the road
ratings, Bruce filled in the application, Peggy and Linda finished and
sent to the state. Now we just wait to see if we get any grant money.
Road rating will be a yearly thing so we need to do these ratings in
the spring.
G. Clerk will be out of the office on November 8th, and 9th, 2017.
H. Porsche Kettelhut showed up in the latter part of the meeting after
we had already discussed her request. Chairman stated that her request
is to have an extension to keep the horses, Chairman told her she was
late meeting started at 7:30pm and we had already past her request
under new business letter “B” the board decided to hear her. Chairman
gave her 5 min to present her request. Porsche again stated that she
is a 5013c rescue for horses, there are not regular horses, hard to
handle, and horses all have behavioral and health issues. I have been
trying the last few months to rehome them thru Face Book, Friends,
Social Media, Attorney’s Office, Craig’s List and Family. All the
rescues are full no luck trying to place them. Plus now we have the
holidays, on top of winter, nobody has any money so I am having a
difficult time trying to place them. So she is asking for an extension
of time to get thru winter, she has one girl that might be interested
she is in college right now, she is in school right now and doesn’t
get out till May. Porsche said she discussed this with her attorney
and he said she should ask for the extension to get thru winter. One
of the horses she was trying to get a halter on, she is so severely
abused with broken ribs that anytime you bring out rope or halter she
is petrified they have issues she is trying to work on. Nobody wants
to invest in them. When people get a horse they want a horse that they
can train so they will be able to be trained to be in 4-H and shows.
These horses will never be able to too do that the one with broken
ribs will never be able to have a saddle on her. Porsche said she is
doing what she can. She cannot just open a gate and let them roam free
and I am not going to put them down. These horses are not owned by me
they are owned by the 5013C they are supported by them. Having trouble
placing them at this time. Porsche said she is doing everything she
can to find a solution for this situation. Janet asked about the
couple of horses that are in good health, have you asked other rescue
places? Porsche said she has tried other rescue places, even Dee Dee
at Spirited horse rescue has no room for more. It is not easy people
want horses that are trained.  Janet stated as Porsche has said these
horses are never going to be healthy and what other people would want
they need skilled people to handle them. Porsche stated that she has
been running an ad in Craig’s list the last couple of months. Again
this is the worst time of the year to try and find placement. They are
getting very good care right now, she is doing whatever she can. Janet
said we gave you until November 30th, 2017 and that was rom the
meeting in August 2017. Now we have to get ready for winter and
everything else. Greg Neumann, you can’t board the horses anywhere?
Porsche, we don’t have the funding to board them, Greg how do you have
money to feed them? Because I am 5013C I get regular donations from
people they are supported by them. Porsche stated that as far as the
poop we got into that last month, Janet said the request for the
variance (board of Appeals) was denied last month. Porsche said she
was miss lead and filed the wrong paper work. Porsche said that I the
clerk spoke to the “courts” I did not speak to the courts. Bruce
stated that we are not here for that, Attorney Olson stated that the
clerk is not your legal counsel. Chairman stated Porsche has until the
30th of November 2017 to get rid of the 2 extra horses. Porsche asked
if she was being discriminated against because she feels she is not
getting a fare our former attorney. Porsche asked about proper
producer for a Conditional Use Permit, when you close a public hearing
is anyone allowed to speak? After it closed can anyone speak? Attorney
said yes, the board can ask questions she said she was shut down, Mike
Vogel’s letter was read after the close of the hearing. Porsche
requested a copy of the recording for the November 6th, 2017 meeting.
Argument broke out Chairman said we are done. Moving on. I gave her a
copy of the state statutes stating that we can charge for recordings
in her last set of recordings she picked up. November 30th, 2017 is
the deadline.

	Moved by Fox, seconded Coplien, that Voucher #319 through and
	including #356 be approved for payment. Motion carried on voice
vote.

	Moved by Coplien, seconded by Rebout, to adjourn. Motion carried on
      Voice vote.
   Meeting adjourned at 8:24 p.m.
